§ 1 Information about the Contractual Partner, Scope of Application of the General Terms and Conditions (GTC)

These General Terms and Conditions (GTC) apply to all orders and bookings made by consumers within the meaning of § 13 of the German Civil Code (BGB) and entrepreneurs within the meaning of § 14 BGB (together: Customers) with Daniel Lexow.
Contrary or supplementary terms and conditions of the entrepreneur shall only become part of the contract if the provider expressly agrees to them.
§ 2 Right of Withdrawal
If the buyer is a consumer, he has the following right of withdrawal:
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of conclusion of the contract. To exercise your right of withdrawal, you must inform us (Daniel Lexow, Wilhelm-Külz-Str. 22, 17033 Neubrandenburg, Germany, Telephone: +49 1746008300, Email address: mail@danlexow.com) by means of a clear statement (e.g., a letter sent by post, fax or email) of your decision to withdraw from this contract. You can use the attached sample withdrawal form, which is not mandatory, to do so. To comply with the withdrawal period, it is sufficient for you to send the notification of exercising the right of withdrawal before the withdrawal period expires.
§ 3 Special Provisions for Seminars
The organizer of the seminars is, unless expressly stated otherwise, Daniel Lexow.
Services of the Organizer, Seminar Content, Changes
The organizer enables the customer to participate in the face-to-face or online seminar booked by him.
The presenting lecturers are free to design their presentations and are responsible for the content of the seminar lecture. The organizer assumes no responsibility for the content of the seminar. Success associated with seminar participation is neither guaranteed nor owed by the organizer.
All information about the venue and schedule of the event will be communicated to the customer in good time before the seminar begins. The subject matter, scope, form, and objectives of the seminar are evident in the seminar program. For an online seminar, the customer must have suitable end devices and an adequate internet connection. The technical requirements are specified in the seminar program.
For face-to-face seminars, travel, accommodation, and meals - unless otherwise agreed - are not included in the seminar price and must be borne by each customer individually.
After payment of the seminar fee, the customer will be provided with the admission ticket (for face-to-face seminars) or the access data (for online seminars).
The organizer is entitled to make changes to the seminar for important reasons, if and to the extent that this is reasonable for the customer. This applies in particular to the appointment of a substitute lecturer in the event of the announced lecturer's absence, as well as a change in the seminar date and location.
If the seminar cannot be conducted as planned due to force majeure, pandemics (e.g., Corona), official orders, illness, accident, or other circumstances beyond the organizer's control, the organizer is entitled to hold the seminar on an alternative date or to conduct a face-to-face seminar as an online seminar.
Payment Terms
The invoice amount is due immediately.
Payment is possible via different payment methods. Any resulting return debit fees due to insufficient funds in the participant's account are to be borne in full by the participant.
As long as the seminar fees have not been paid in full, the customer is obliged to inform the organizer immediately of any changes to his bank or credit card details.
Cancellations, Changes, Transfer of Admission Tickets
For face-to-face and online seminars, the customer can cancel his booking up to 2 weeks before the start of the seminar. The cancellation must be made in writing (e.g., letter, fax, email) to the organizer. In the event of cancellation, a fee of 30% of the seminar fees will be charged. For bookings made less than 2 weeks before the start of the seminar, a cancellation fee of 50% will be charged. For the booking of bundles or seminar packages, cancellation is only possible for the entire booking and under the conditions mentioned, thus the date of the first event is used as the basis for the possibility of cancellation.
The booked seminar can be rebooked once free of charge with the organizer's consent. There is no entitlement to rebooking.
Rebooking is only possible if the seminar fee has been paid in full.
The admission tickets for face-to-face seminars are transferable to third parties. For online seminars, the access data is tied to the customer's person and may not be passed on to third parties.
The consumer's right of withdrawal is not affected by the above conditions.
§ 4 Final Provisions
Contracts between the provider and customers are subject to the law of the Federal Republic of Germany, with the UN Sales Convention being expressly excluded. The statutory provisions regarding the limitation of choice of law and the applicability of mandatory provisions, in particular those of the state in which the customer has his habitual residence as a consumer, remain unaffected.
If the customer is a merchant, a legal entity, a public legal entity, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the provider is Neubrandenburg.
Even if individual points of the contract are legally ineffective, the contract remains binding in its other parts. Instead of the ineffective points, the statutory provisions apply, if available. If this would represent an unreasonable hardship for one party to the contract, the contract as a whole becomes ineffective.
The exclusive place of jurisdiction is Neubrandenburg.
